Intoxicating Liquor Licenses

The City issues on-sale wine licenses, with the approval of the Commissioner of Public Safety, to: theaters, restaurants that have facilities for seating at least 25 guests at one time and meet the criteria of Minn. Stat. § 340A.404, subd. 5, as it may be amended from time to time, and which meet the definition of restaurant in section 3; to licensed bed and breakfast facilities which meet the criteria in Minn. Stat. § 340A.4011, subd. 1, as it may be amended from time to time and to theaters that meet the criteria of Minn. Stat. § 340A.404, subd. 1(b) as it may be amended from time to time. The fee for an on-sale wine license established by the Council under the provisions of 114.0010 of this ordinance, shall not exceed one-half of the license fee charged for an on-sale intoxicating liquor license. The holder of an on-sale wine license who also holds an on-sale 3.2 percent malt liquor license is authorized to sell malt liquor with a content over 3.2 percent (strong beer) without an additional license
The City issues 3.2 percent malt liquor on-sale licenses to golf courses, restaurants, hotels, clubs, bowling centers, and establishments used exclusively for the sale of 3.2 percent malt liquor with the incidental sale of tobacco and soft drinks.

Are you a therapeutic massage enterprise? An enterprise is an entity which operates a business that hires only licensed therapeutic massage therapists to provide therapeutic massage to the public. The owner/operator of a therapeutic massage enterprise need not be licensed as a therapeutic massage therapist if he or she does not at any time practice or administer massage to the public. A therapeutic massage enterprise may employ other individuals such as cosmetologists and aestheticians. These individuals are not required to have a massage therapist license as long as they are not providing therapeutic massage to the public.

The City regulates food trucks through City Code Title XV Land Use, Chapter 156, Section 156.093 Mobile Food Vendors. What is our definition of a mobile food vendor? It is:
Mobile Food Vendor. Any person intending to sell items out of a mobile food unit, seasonal temporary food stand, or seasonal permanent food stand for no longer than six (6) months in a calendar year and is located on private property.
Mobile Food Unit. A food and beverage service establishment that is a vehicle mounted unit, either: (1) motorized or trailered, operating no more than 21 days annually at any one location, or operating more than 21 days annually at any one location with the approval of the regulatory authority as defined in Minnesota Rules, part 4626.0020, subpart 70; or (2) operated in conjunction with a permanent business licensed under Minnesota Chapter 157 or Minnesota Chapter 28A at the site of the permanent business by the same individual or company, and readily movable, without disassembling, for transport to another location.

Temporary/Seasonal Outdoor Sales Use is the display or sale of the following items: Christmas trees, nursery stock, plants and related materials; and lawn, garden, patio furniture and furniture accessories. When these items are the primary merchandise offered for sale by the principal use, such as for nurseries, it shall not be considered a Temporary/Seasonal Outdoor Sales Use.
Transient vending is the conducting of business out of a vehicle, trailer, boxcar, tent, other portable shelter, or empty store front for the purpose of exposing or displaying for sale, selling, or attempting to sell, and delivering, goods, wares, products, merchandise or other personal property; farmer’s markets, and antique/flea markets but not to include vehicles.

What is a Peddler? A Peddler is a person who goes from house-to-house, door-to-door, business-to-business, street-to-street, or any other type of place-to-place, for the purpose of offering for sale, displaying or exposing for sale, selling or attempting to sell, and delivering immediately upon sale, the goods, wares, products, merchandise or other personnel property that the person is carrying or otherwise transporting.

We have two types of home occupation permits:
- Home Occupation: no retail, cannot be in the garage, no non-household members shall be employees. No cost.
- Extended Home Occupation: may be in garage, up to one non-household member as an employee, and Interim Use Permit is required, limited retail allowed. $300 bi-annually or a timeframe set by City Council.
